What is land consolidation and how does it differ from ordinary legal processes?
Land consolidation is a court process in which the land consolidation court reshapes property and usage rights to make the properties more useful overall. The court can also clarify existing legal relationships through cases concerning boundaries and legal clarification, in which it determines the content of the property and usage rights and where the boundaries actually lie. A fundamental starting point is that the land consolidation process should result in an overall improvement in property conditions (consolidation gain), and that no property should be worse off. This is because the costs and disadvantages of each individual property should not be greater than the benefits for the individual property.
The Land Consolidation Court is a specialised court with particular competence to both determine and change property and legal relationships, while the District Court primarily decides disputes and criminal cases. In cases of boundary determination and legal clarification, the formal competence is basically the same, but in practice the Land Consolidation Court handles most boundary cases and has special technical expertise in surveying and maps. Nor does land consolidation require a conflict to exist; many cases are brought precisely to prevent future conflicts and facilitate development. For many boundary and rights cases, land consolidation will therefore be a more practical and simpler way forward than bringing an ordinary case before the district court, because in one and the same process the parties can both clarify the boundaries and adapt the property and usage rights to current needs.
When is it a good idea to use land consolidation?
Land consolidation is particularly relevant when properties are difficult to utilise appropriately, for example because the boundaries are unclear, the plots are inconveniently located or the rights of use overlap. Typical situations are co-ownerships and real estate co-ownerships with unclear boundaries and unclear rules of use, agricultural properties with many small plots, cabin estates with shared driveways, car parks and other common areas, and development areas in towns and cities where several properties are to be developed together as an urban land consolidation. Through land consolidation, it is possible to achieve a better plot structure, clear boundaries, orderly usage arrangements and added value that is distributed between the properties according to clear principles.
Which cases does the land consolidation court handle?
Under the Land Consolidation Act, the Land Consolidation Court can hear claims for changes to property and usage rights in order to create more favourable conditions, determine property and usage rights (legal clarification), set boundaries for property and usage rights as well as assessments and other decisions under special legislation, including expropriation assessments and cases under the Easements Act. This includes the exchange of land between properties, dissolution or reorganisation of joint ownerships, arrangements for the use of grazing, roads, fishing or common areas in cabin areas, redemption and amendment of easements, urban land consolidation in development areas and combined cases where land consolidation is carried out together with expropriation assessments.
What is the cost of land consolidation?
The costs in a land consolidation case consist partly of legal costs to the land consolidation court - such as fees and expenses for co-judges - and partly of the parties' own costs for lawyers and any other advisers. As a general rule, the land consolidation court's legal costs, with the exception of costs for legal aid and other experts, are allocated according to the benefit the parties derive from the land consolidation case. As a starting point, the parties pay their own legal fees, but the outcome of disputes in the case may affect whether someone has to cover the other party's costs.
Halvorsen provides an early and realistic assessment of the benefits, risks and expected costs, so that you have a sound basis for decision-making before the case is brought.
When is it a good idea to use a lawyer in land consolidation cases?
Land consolidation is a specialised field with specific conditions and procedural rules. The conditions for promoting land consolidation mean, among other things, that the properties as a whole should be improved and that no property should suffer a loss because the costs and disadvantages exceed the benefits for the individual property. It is particularly appropriate to use a lawyer when there is disagreement about property boundaries or the content of usufruct rights, when the case concerns large condominiums, cabin sites or development projects, when significant values or complicated valuations are involved, or when land consolidation is combined with expropriation assessments or other assessment cases.
Our lawyers assist in assessing whether land consolidation is the right form of litigation, drafting claims, strategies for negotiations and proceedings before the land consolidation court, district court and court of appeal.
