The insurance terms and conditions will determine whether you can claim payment under an insurance policy. These will be sent to you by the insurance company when the insurance contract is concluded.
The most common types of insurance for consumers are accident insurance, travel insurance, disability insurance and debt insurance. Contractual insurances are in addition to liability insurances such as car, occupational injury, patient injury, etc.

Accident insurance and insurance law
You may be entitled to a payout under accident insurance if you suffer permanent injury in an accident. What counts as an accident is defined in the insurance terms and conditions. However, practice shows that the concept of accident has a broader scope than a purely linguistic interpretation of the terms would indicate. The definition in the terms and conditions should therefore be compared with case law in this area.
Payment under an accident insurance policy is linked to the extent of the injury you have suffered, also known as medical disability. The medical disability is determined by a medical specialist 1-3 years after the accident. It is important to ensure that the medical expert receives complete information about the accident and injuries. It may therefore be appropriate to consult a lawyer with experience in the area before contacting the medical expert.
Disability insurance
The design of disability insurance policies varies. However, these are normally paid out when you have been disabled for two years and the disability is judged to be permanent. Some insurance policies link this to the granting of a permanent disability pension from the National Insurance Scheme and it is therefore important that you make a claim for disability pension as early as possible.
Disability insurance is not linked to the degree of medical disability, but to your future loss of income due to the accident. You may therefore be entitled to a disability insurance payment even if you have a low degree of medical disability.

Debt insurance
Debt insurance is entered into in connection with loan agreements and means that the loan is fully or partially covered if the terms of the accident insurance are met. The wording of the terms varies, and the payment may be linked to occupational disability and medical disability. It is important to note that debt insurance, unless otherwise agreed, lapses when the loan is repaid. This also applies if the loan is refinanced with another bank. If you may be entitled to payment of debt insurance, it is therefore important that you do not change the loan relationship before the debt insurance has been paid out.
Notification deadlines - 1 year
In most insurance policies, the claim must be reported within one year of the insured event occurring. In addition, you are entitled to interest on the insurance amount from two months after the claim was reported to the insurance company. It is therefore important that you report the claim as early as possible.
