Traffic damage after chain collision
A 51-year-old woman was injured in a road accident after a chain collision. The injured party suffered a neck injury after whiplash. The neck injury became chronic with pain and stiffness in the neck, with associated headaches. She took sick leave from work, received work assessment allowance and was granted 100 % disability pension.
At the time of the accident, the injured party was employed as a secretary with extensive professional experience. Two months after the accident, she was dismissed due to downsizing at the workplace.
The responsible car insurance company denied liability on the grounds that the accident was not capable of causing injury, that the development of injuries was not as expected after a neck injury, and that the neck injury was a continuation of neck problems before the accident. Furthermore, the insurance company believed that the loss of income was due to the difficult labour market and that the injured party would have become disabled regardless of the traffic accident.
The insurance company made an offer of NOK. 150 000,-. In Oslo District Court's judgement of 25 February 2014, the injured party was awarded NOK. 1,793,000 and full legal costs.
