The injured party, a middle-aged man, was hit by a car at a pedestrian crossing and sustained injuries. In the subsequent treatment at the hospital, the injured party suffered additional injuries as a result of a failure in the health service. The injured party suffered a head injury and also had to have a leg amputated. The car's insurance company and NPE were both liable for the loss that occurred.

The injured party became fully disabled, had to rebuild his home and required extensive assistance.
