The creditor cannot necessarily rely on the debtor's credentials

In its ruling of 10 September 2015, the Supreme Court's Appeals Committee concludes that a creditor may not rely solely on the debtor's credentials, and thus may not unilaterally deprive third parties of their rights in the event of a conflict of title. The ruling entails a confirmation of previous practice and legal theory. Advokatfirmaet Halvorsen & Co believes that the ruling will typically be relevant to ownership through straw men.
