Lower back pain after traffic injury
A young woman worked as a teacher. On her way to work, her car spun and she drove off the road. She immediately suffered lower back pain that persisted. After long periods of sick leave, rehabilitation and work trials, it became clear that she was to be considered fully disabled. She suffered a major financial loss.
The insurance company argued that there was no causal link between the accident itself and the injury the woman had suffered. It was claimed that the accident itself could not cause permanent injury to a person, and that the ailments she experienced must have had another cause. The company therefore believed that she was not entitled to compensation.
The injured party therefore chose to sue the insurance company. She won the case in full in the district court. The insurance company appealed to the Court of Appeal. However, Agder Court of Appeal agreed with the young woman and ruled unanimously that she was entitled to full compensation totalling NOK 2.5 million. 2.5 million.
