In the new NRK series «Arveoppgjøret» (The Inheritance Settlement), families are helped to plan future inheritance settlements. "It's great that NRK is putting this important topic on the agenda.
There are several reasons why the conversation about inheritance can be very difficult. The first, and obvious, reason is that when you talk about legacy, you have to talk about death. The very realisation that the people close to us will not be around forever is a difficult subject. The topic is not made any easier by the fact that it is largely about money. For many people, it can feel somewhat greedy to make requests for objects and assets. Furthermore, there are often «many hands on deck» when it comes to generational changes. There is only one family home, and all three children want to take it over. In other words, there are many factors that make many people reluctant to start this dialogue.
Few areas of life generate as much conflict as inheritance, and the possibility of avoiding conflict should in itself be a motivation to start the dialogue while alive. If such a dialogue can prevent future discord, it should be a small price to pay. As shown in the NRK series, the dialogue can present both challenges and disagreements. At the same time, the families experience it as a great relief afterwards. As lawyers, we assist many clients in similar situations, and we find that clients feel relieved after drawing up a will. Many people have to go through several rounds of discussions with themselves and their family before they arrive at a well thought-out solution that everyone is happy with.
The series has a good focus, namely that any disagreements in the family are addressed and attempted to be resolved before it is too late. In families where the subject has never been raised, there is a far greater risk of conflicts arising in a future inheritance settlement.
The rules in the Inheritance Act are largely adapted to the traditional nuclear family, which is less prominent in today's society than in the past. This means that the rules of the Inheritance Act are suitable for fewer and fewer families. As a result, more and more people need a will to achieve what they perceive as a fair distribution.
