What amounts for lawyers are covered by the legal expenses insurance?
Legal expenses insurance is regulated in the insurance terms and conditions and may vary slightly from company to company. Normally, legal expenses insurance covers your legal fees in the event of a dispute up to a maximum of NOK 100,000, but not more than the financial interest involved in the dispute.
You usually have to pay a deductible, which in most insurance policies amounts to the first NOK 4,000. In addition, you must pay a deductible corresponding to 20 per cent of what is paid out under the insurance.
This means that in most cases, you as a policyholder will have to pay a deductible of NOK 29,000 if you fully utilise the legal expenses insurance of NOK 100,000.
Which disputes are covered by the legal expenses insurance?
Legal expenses insurance can be used in a number of different disputes:
- Compensation after a road accident
- Compensation after a boating accident
- Compensation after a plane crash
- Compensation for errors or defects in the purchase and sale of real estate
- Neighbour dispute
A few insurance companies also offer legal expenses insurance for occupational injuries and occupational disease.
It is important to notify the insurance company where you have legal aid cover as soon as possible, and no later than one year after the dispute has arisen.
All disputes are covered unless the dispute is excluded in the insurance terms and conditions. Examples of disputes that are usually not covered are:
- Disputes about profession and occupation
- Family and inheritance disputes
- Separation and divorce disputes
- Child custody dispute
