Compensation for lung injury?

What is a lung injury?

A lung injury is an injury to the lungs.

What causes lung damage?

A lung injury normally occurs in two ways:

1. A «mechanically» inflicted injury resulting from a sudden external event.
2. Exposure to hazardous gases or other harmful substances.

What kind of accidents can lead to lung injury?

Lung injuries often occur in accidents involving large objects such as vehicles, machinery or trees, and can happen, for example, in traffic or during work in the construction industry, the offshore industry, traditional industry or the forestry and agricultural industry.

Lung injuries can also occur during work in the chemical industry, for example, or in other industries where employees are exposed to harmful substances.

What are the most common accidents that can result in lung injury?

If you suffer impact injuries, impact damage, fall injuries, multiple trauma, explosion damage or clamping damage it can lead to damage to the lungs as well as other organ damage. The most common accidents with lung injuries are occupational injuries, road accidents and leisure accidents.

What should I do if I suffer a lung injury?

If you've been injured, it's important to notify the relevant insurance companies as soon as possible. If the lung injury was sustained in connection with work, the injury must also be reported to NAV and possibly to Labour Inspection Authority and the police if the damage is serious.

Am I entitled to compensation for lung injury?

Yes, you can. You may be entitled to compensation.

If the injury occurred at work, you are probably entitled to compensation for occupational injury.
If you have fallen ill at work, you are probably entitled to compensation for occupational disease.
If the injury occurred in traffic, you are probably entitled to compensation from the insurance company of the vehicle that injured you.
If the damage occurred in leisure time, you are entitled to compensation under accident insurances or travel accident insurance if you had such insurance.
If the damage occurred in a boating accident, you can claim compensation under the boat's liability insurance, under the skipper's or boat owner's liability insurance, or directly from the skipper or boat owner.
If your injury occurred in an aircraft accident, you are covered by mandatory accident insurance that all airlines must take out.
If the injury occurred due to violence, you may be entitled to compensation from the perpetrator, their liability insurance or from Office for Victim Compensation.
If the injury occurred during medical treatment, you may be entitled to compensation from Norwegian Patient Injury Compensation.

What types of compensation am I entitled to?

As an injured person, you may be entitled to the following types of compensation:

You may also be entitled to compensation under accident insurance policies and under disability insurances if the injury renders you fully or partially unable to work.

How much can I receive in compensation?

The size of the compensation depends on the severity of the injury and the consequences it has for your ability to work. Your age also affects the amount of compensation if you have lost the ability to work. In addition, there is the size of the expenses you have incurred.

Is there a disability table for lung injuries?

Yes. Disability table is the starting point for assessing the injured party's medical degree of disability (MDD), and thus what you are entitled to in terms of compensation, and to determine how much you may be entitled to receive under accident insurance policies.

The Disability Table sets out the medical disability percentage for a number of diagnoses, and this sets the framework for the assessment of your medical disability, which is determined by a medical expert.

The disability table is set out in a separate regulation called Regulations on workers' compensation for occupational injuries, but is also used for other damage incidents, such as road accidents, leisure accidents, boat accidents and aircraft accidents.

Is lung injury recognised as an occupational injury by NAV?

Answer. If the injury is due to an accident while working for an employer at the workplace, you can apply for NAV for recognition of lung injuries as occupational injuries. Similarly, you can apply to NAV for recognition of injuries to your lungs as an occupational disease if these are due to exposure to harmful substances while working for your employer at the workplace.

If you receive a decision from NAV that you have a «recognised occupational injury» or occupational disease, you will automatically receive benefits in the NAV system.

Among other things, you can avoid paying a deductible for treatment by a doctor or physiotherapist by presenting the decision on «approved occupational injury».

As a general rule, you can also be reimbursed for expenses for medicines and special medical equipment. You may also be entitled to compensation from NAV.

Do I need a lawyer?
